Terms of Service

1. Agreement
By accessing or using dictateand.com and the dictate& application ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Service Description
dictate& is an AI-powered voice dictation application designed for professionals. The Service transcribes spoken audio into formatted documents.
3. Subscriptions and Payment
The Service is offered on a subscription basis. Current plans, pricing, and included features are described on our pricing page. By subscribing, you authorise us to charge your nominated payment method on a recurring basis at the applicable rate.
Subscriptions renew automatically at the end of each billing period (monthly or annual, as selected) unless you cancel before the renewal date. Payment is processed by Stripe. We will notify you of any price changes before they take effect.
4. Cancellation and Refunds
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; you retain full access until then.
We do not offer refunds for partial billing periods, except where required by applicable law or where we terminate your account without cause (see Section 13).

5. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use this Service. By using the Service, you represent that you meet these requirements.
6. User Responsibilities
When using the Service, you agree to:
- Provide accurate information when registering
- Use the Service only for lawful purposes
- Not attempt to reverse-engineer, copy, or redistribute the Service
- Not use the Service in any way that could damage, disable, or impair it
- Not share your account credentials with others
- Not upload content that infringes third-party rights or violates applicable law
7. Intellectual Property
The Service, including its design, code, and branding, is owned by dictate&. You retain ownership of any content you create using the Service. By using the Service, you grant us a limited licence to process your content solely for the purpose of providing the Service.
8. Accuracy and Limitations
dictate& uses AI to transcribe and format documents. While we strive for accuracy, the Service may produce errors. You are responsible for reviewing all output before use. dictate& is not a substitute for professional judgement and should not be relied upon as the sole basis for any legal, medical, or other professional work product.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or uninterrupted availability, to the fullest extent permitted by applicable law. We do not warrant that the Service will be error-free or that any defects will be corrected.
10. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. All data is stored within the European Union. Where you use the Service to process personal data belonging to third parties (such as clients or patients), you are the data controller for that data and are responsible for your own compliance with applicable data protection law.
11. Limitation of Liability
Nothing in these Terms limits or excludes liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under applicable law.
Subject to the above, and to the maximum extent permitted by law, dictate& shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability for direct losses shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
12. Professional and Regulatory Obligations
If you are a regulated professional — including barristers, solicitors, medical practitioners, or others subject to professional rules or confidentiality obligations — you are solely responsible for ensuring that your use of the Service complies with your applicable professional codes of conduct, regulatory requirements, and legal obligations, including any obligations regarding client confidentiality and data protection.
You warrant that you have the necessary authority, and where required the appropriate consent or legal basis, to process any third-party personal data through the Service. Professional users are encouraged to obtain a Data Processing Agreement from us — contact hello@dictateand.com.
13. Termination
We may suspend or terminate your access to the Service for cause — including breach of these Terms, non-payment, or misuse — with reasonable notice where practicable, or immediately where required for security or legal reasons.
If we terminate your paid subscription without cause, we will provide a pro-rata refund for any prepaid period remaining.
You may stop using the Service at any time. Upon termination, your right to use the Service ceases; however, you will have 30 days to export your data before it is permanently deleted, unless your account was terminated for breach of these Terms.
14. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email and/or in-app notification at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes your acceptance of the updated Terms. If you do not agree with a material change, you may cancel your subscription before the effective date without penalty.
15. Governing Law
These Terms are governed by the laws of Ireland. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ireland.
